These Terms of Service (“Terms”) govern your access to and use of the BidMate mobile application, marketing website, and any related services (collectively, the “Service”) provided by BidMate (“we”, “us”, or “our”). By downloading, installing, or using BidMate, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Description of the service
BidMate is a reference and calculation tool for auction professionals and serious bidders. It estimates the buyer's premium and final cost of a hammer price across supported auction houses and converts those amounts between currencies at live exchange rates. BidMate is not affiliated with, endorsed by, or representative of Christie's, Sotheby's, Phillips, or any other auction house referenced in the Service.
2. Subscription, free trial, and renewal
BidMate offers a paid subscription with a three-day free trial for new users. Subscriptions are billed annually and renew automatically at the end of each term unless cancelled. Pricing is displayed in your local currency on the App Store or Google Play and may change with reasonable notice.
Cancellation is handled entirely through your App Store or Google Play subscription settings. Cancelling before the end of a free trial avoids any charge. Cancelling after a paid term has begun prevents future renewal but does not entitle you to a prorated refund of the current term.
3. Refunds
Refund requests are governed by the policies of the platform through which you purchased the subscription (Apple App Store or Google Play). We do not process refunds directly.
4. Disclaimers
BidMate is for reference only.The premium rates, currency conversion rates, and final-cost estimates provided by the Service are calculated based on data we configure from publicly published auction-house schedules and third-party FX providers. Auction houses revise their premium structures from time to time without notice. Currency rates fluctuate continuously. Final invoiced amounts may differ from BidMate's estimates. Always confirm the final cost with the auction house and your bank before bidding.
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.
5. Limitation of liability
To the fullest extent permitted by law, BidMate, its operators, and its affiliates shall not be liable for any indirect, incidental, consequential, or special damages arising out of or in connection with your use of the Service, including but not limited to financial losses arising from incorrect or outdated calculations. Our total aggregate liability shall not exceed the amount you have paid us for the Service in the twelve months preceding the claim.
6. Intellectual property
All content in the Service — including but not limited to software, trademarks, logos, copy, illustrations, and design elements — is owned by BidMate or licensed to us. You may not reproduce, redistribute, modify, or reverse-engineer any part of the Service without our prior written consent.
Auction-house names and trademarks (Christie's, Sotheby's, Phillips, and others) referenced in the Service are the property of their respective owners and are used for identification purposes only.
7. Changes to these terms
We may update these Terms from time to time. Material changes will be reflected by a revised “Last updated” date at the top of this page and, where appropriate, surfaced in-app. Your continued use of the Service after such updates constitutes acceptance of the revised Terms.
8. Governing law
These Terms are governed by the laws of the United Arab Emirates, without regard to its conflict-of-law principles. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE.
